At Simon Diez Photography LLC and The Lounge | Creative Studio, we respect your privacy and recognize the importance of protecting your personal information, photographs, and trust.
This Privacy Policy explains how we collect, use, store, and share personal information when you visit our website, contact us, book a session, rent our studio, attend an event, or purchase our products and services.
Our website is www.simondiez.com.
1. Information We Collect
Depending on how you interact with our business, we may collect:
Personal Information
Your name, email address, telephone number, billing details, and other information you voluntarily provide when contacting us, booking services, or completing a purchase.
Booking Information
Appointment dates, selected services, session preferences, number of participants, and information submitted through booking forms.
Photographs and Creative Materials
Photographs, videos, image selections, and other materials created during photography sessions or voluntarily provided by clients.
Payment and Transaction Information
Purchase records, transaction amounts, deposits, payment status, and related billing details. Payments may be processed through third-party payment providers.
Website Usage Information
Certain technical information, including IP addresses, browser types, device information, pages visited, and interactions with our website, may be collected through website functionality, cookies, analytics, and other technologies.
2. How We Use Your Information
We use personal information for legitimate business purposes, including:
Responding to inquiries and communicating with clients.
Scheduling and managing appointments.
Processing reservations, purchases, and payments.
Preparing and delivering photography services.
Providing access to private client galleries.
Managing portrait selections, retouching, and digital delivery.
Managing studio rentals, workshops, and events.
Providing customer support and resolving service concerns.
Maintaining business records and complying with applicable legal obligations.
Improving our website, services, and customer experience.
Sending promotional communications where permitted by applicable law and your communication preferences.
We do not require clients to authorize promotional use of their photographs as a condition of purchasing a standard photography service.
3. Photography, Client Galleries & Image Privacy
Client photographs are professionally edited, stored, and delivered using Dropbox, a third-party cloud storage and file-sharing service.
Upon completion, clients receive a Dropbox sharing link to access and download their purchased digital portraits.
By default, gallery links may be accessible to anyone who possesses the link, allowing clients to conveniently share their photographs with family members and other trusted individuals.
Clients who prefer additional privacy may request restricted access. Available privacy options depend on the sharing features supported by our Dropbox account.
We encourage clients to share their gallery links responsibly, particularly when photographs include children or other sensitive personal content.
Dropbox processes and stores files according to its own privacy and security policies.
We do not publish client portraits for advertising, social media, or promotional purposes without appropriate authorization where required. Such permission is handled separately through a Model Release.
4. Photographs of Children
We take the privacy of children and families seriously.
Photographs of minors are collected and processed in connection with services arranged by a parent, legal guardian, or other appropriately authorized adult.
When promotional permission is required for a minor's photograph, we seek authorization from an appropriate parent or legal guardian through a separate Model Release.
We do not require families to agree to promotional publication of their children's portraits in order to purchase a photography session.
Our website and online booking services are intended for adults arranging photography services, rather than for children to independently submit personal information.
5. Booking & Scheduling Services
We may use Squarespace Scheduling, also known as Acuity Scheduling, to manage appointments, collect booking information, process deposits, and send confirmations or reminders.
Information submitted through the booking system may be processed and stored by the scheduling provider in accordance with its applicable policies.
We use booking information to administer the services requested and to maintain accurate appointment records.
Clients may be asked to acknowledge our Terms & Conditions and Privacy Policy before completing a reservation.
6. Payment Processing
Payments may be handled by third-party payment processors.
These providers may collect and process payment information required to authorize transactions, manage refunds, and prevent fraud.
We receive transaction details needed for business administration but do not need to receive complete payment card numbers to fulfill photography services.
Payment processors operate under their own applicable privacy and security policies.
7. Cookies, Analytics & Website Technologies
Our website may use cookies and similar technologies to support essential functions, understand website performance, and improve visitors' experiences.
Depending on the tools enabled on our website, certain technologies may also support advertising measurement or marketing.
Some cookies are necessary for website functionality, while others may be subject to visitor preferences or applicable consent requirements.
You can manage certain cookies through your browser settings and any cookie preference controls made available on our website.
Third-party services may maintain their own policies governing the information they collect.
8. Marketing Communications
We may send information about photography experiences, studio events, seasonal campaigns, workshops, and related services where permitted by law.
You may unsubscribe from promotional emails using the unsubscribe mechanism provided in those messages or by contacting us directly.
Opting out of marketing communications does not prevent us from sending necessary service communications, such as booking confirmations, payment notices, appointment reminders, or portrait delivery information.
9. When We Share Information
We do not sell personal information in exchange for money.
We may share information with service providers when reasonably necessary to operate our business and deliver requested services.
Depending on the services in use, these providers may include:
Website hosting and scheduling providers.
Payment processors.
Private gallery and digital delivery platforms.
Professional editing, storage, and backup services.
Email and client communication platforms.
Analytics and advertising technology providers.
Professional advisers and service providers assisting with lawful business operations.
We may also disclose information when reasonably necessary to comply with legal obligations, respond to lawful requests, protect rights or safety, or address suspected fraud.
The use of certain advertising or analytics technologies may constitute sharing or other regulated data processing under applicable privacy laws, even when no monetary sale takes place.
10. Data Security
We take reasonable administrative, technical, and organizational measures designed to help protect personal information and client images from unauthorized access, disclosure, alteration, or loss.
Access to client information is limited according to business needs.
Although we use reasonable safeguards, no internet-based system, electronic transmission, or storage method can be guaranteed to be completely secure.
11. Data Retention
We retain personal information and business records for as long as reasonably necessary to provide services, maintain transaction records, meet legal obligations, resolve disputes, and support legitimate business needs.
Photographs and related files may be retained for editing, delivery, backup, archival, or other purposes consistent with the client agreement.
We do not guarantee indefinite storage of client photographs or permanent access to private galleries.
Applicable retention periods may differ depending on the information involved, contractual commitments, and legal requirements.
12. Your Privacy Choices
Depending on your location and applicable law, you may have rights to request access to, correction of, or deletion of certain personal information.
You may also request information about how your data is used or withdraw certain permissions where permitted.
To submit a privacy inquiry or request, please contact us using the information below.
We may need to verify your identity before responding to certain requests, and some information may need to be retained to comply with legal obligations or fulfill existing agreements.
13. Third-Party Websites & Services
Our website may contain links to third-party websites, booking services, payment processors, galleries, or other platforms.
These providers operate under their own privacy policies and terms.
We encourage visitors to review the privacy policies of third-party services they choose to use.
14. Model Releases & Promotional Permissions
Permission to use photographs for advertising, marketing, social media, exhibitions, publications, or other promotional purposes is handled separately through an applicable Model Release.
A Model Release is distinct from this Privacy Policy and from the agreement governing a photography session.
Where a client has not provided the required promotional authorization, we will not treat acceptance of this Privacy Policy as permission to publish that client's portraits.
15. Changes to This Privacy Policy
We may update this Privacy Policy to reflect changes in our services, technology, business practices, or applicable legal requirements.
When changes are made, the updated version will be posted on this page with a revised effective date.
Any additional notice required by applicable law will be provided when appropriate.
